 <p>
 When acquiring a new laptop you often end up dealing with an imposed 
 pre-installed Microsoft Windows operating system. Even if you do not 
 want to use it, you still need to pay for the Windows license. This is 
 unfair. The Refund4Freedom initiative guides users in how to get 
 their money back in these cases and demands the end of this practice 
 that limits user freedom.

 <p>As a user, you have most likely encountered the
 issue that most laptops are being sold with a pre-installed
 Windows operating system. While this alone might seem like a minor
 inconvenience, it becomes problematic as the cost of the Microsoft
 Windows license is bundled in without an effective and easy way for consumers to opt out.</p>
 <p>This standardized practice not only adds extra costs for the consumers, if they do not want
 that pre-installed software, but also comes with another issue: the
 hardship of saying no to it and getting a refund. Forcing consumers to 
 buy software every time they acquire a new device
 without the possibility to reject the software bundling is against
 <a
 href="/activities/deviceneutrality/index">Device
 Neutrality</a>. Besides it is illegal
 when manufacturers do not allow consumers to recover the licensing
 costs of unused software.</p>
 <h3>Time to change: join our Refund4Freedom
 initiative!</h3>
 <p>Joining forces with the Italian Linux Society (ILS),
 the Free Software Foundation Europe (FSFE) has launched an initiative to
 protect consumer rights when buying a new computer. <a
 href="https://refund4freedom.org/">Refund4Freedom</a> aims to:</p>

 Help consumers to get a refund of thecost of the
 Windows
 License when buying a new device.
 </li>
 <li>
 Provide information on how device manufacturers deal
 with refund queries.
 </li>
 <li>
 Raise awareness against imposed software bundling in
 devices.
 </li>
 <li>
 Demand from device manufacturers better refund
 policies and procedures.
 </li>
 <li>
 Protect the right to use only the software of one's choice.
 </li>
 </ul>
 <p>
 Refund4Freedom is one of a broader set of activities promoting end-users' rights. For instance, the <a 
 href="https://endof10.org/">End of 10 campaign</a> encourages 
 users to 
 keep using their current hardware by switching to Free Software 
 operating systems. This offers an alternative to buying a new device 
 when support for Windows 10 ends on 14 October 2025. By demanding 
 refunds for unwanted pre-installed software, Refund4Freedom supports 
 this transition and helps users avoid unnecessary costs while encouraging
 device neutrality and user-controlled choices.

 <h3>Get inspired! A tenacious example of license refund in Italy</h3>
 <p>Refund4Freedom is inspired by the relentless work of volunteers
 facing great challenges to enforce their rights in exercising software
 freedom. A dramatic example is the <a href="/news/2021/news-20210302-01.html">victorious
 story</a> of Luca Bonnissi, an FSFE supporter from Italy and
 professional developer, against the giant computer manufacturer Lenovo
 in Italian courts.</p>
 <p>The practice of increasing the price of the hardware by including a 
 bundle Windows license is not new; depending on the manufacturer, 
 dealing with it can
 be a long and quite frustrating process. In 2018, Luca filed a request
 to Lenovo for the refund of the cost of the pre-installed Windows license in his
 new Lenovo Ideapad convertible laptop. </p>

 <p>What started as an easy consumer rights request ended up in a 
 bureaucratic and legal quest which took years, several court
 proceedings, and much resilience and determination from Luca. In the
 end, the court confirmed the right to reimbursement for the pre-installed
 software and the decision pointed out that the manufacturer itself had
 expressly assumed this obligation in the Windows license. </p>
 <p>But that is not all: in a historic decision, <a href="/news/2021/news-20210302-01.html">the court
 imposed upon Lenovo punitive damages amounting to 20,000 euros for abuse
 of the appeal procedures</a>: Lenovo forced its customer to take part in
 a disproportionate and unnecessary legal process.</p>
 <p>This decision marked a significant victory against the questionable
 commercial practices of tech companies of obstructing consumers from
 obtaining refunds for pre-installed proprietary software. However, it
 also underlined a harsh reality: while consumers may legally have the
 right to a refund, the actual cost of asserting that right remains high.</p>
 <p>Some manufacturers have defined better policies and clearer
 procedures for requesting and obtaining refunds, as <a 
 href="https://bonissi.it/bonissi_hp/">a similar successful case against
 HP</a> that Luca started in 2019 shows. But for others, consumers are
 forced to engage in persistent correspondence and, in many cases, take
 legal action as a last resort. These companies often use their position
 of power to discourage individuals who do not have the time and resources
 to be involved in a drawn-out litigation just for a Windows license
 refund.</p>
 <p>The <a href="https://refund4freedom.org/">Refund4Freedom initiative
 </a>is showcasing successful cases and documentation in Italy to help
 computer users who want to exercise their rights and request a refund.
 Beyond offering practical tools, the initiative aims to ensure that
 consumers don’t feel alone in this process, by empowering them with
 knowledge and guidance, that manufacturers should not impose
 specific operating systems on them.</p>

 Quando acquisti un nuovo laptop, spesso è incluso il sistema operativo 
 Windows preinstallato e imposto. Anche se decidi di non usarlo, devi 
 pagare la licenza. Questo é ingiusto. La nuova iniziativa Refund4Freedom 
 ti guida per ottenere un rimborso e chiede la fine di questa pratica che 
 limita la libertà degli utenti.

 <p>Come utente, ti sarà probabilmente capitato di notare che la maggior 
 parte dei portatili viene venduta con Windows 
 come sistema operativo preinstallato. Sebbene questo possa sembrare un inconveniente minore, il 
 problema diventa serio quando si considera che il costo della licenza 
 Windows è incluso nel prezzo, senza offrire ai consumatori un modo 
 semplice ed efficace per rifiutare questa imposizione.</p>
 <p>Questa pratica standardizzata non solo aggiunge costi non necessari per 
 i consumatori che non desiderano il software preinstallato, ma comporta 
 anche un altro problema: la difficoltà di dire no e ottenere un 
 rimborso. Costringere i consumatori ad acquistare un software ogni volta 
 che si compra un nuovo dispositivo, senza la possibilità di rifiutare il 
 “bundling” del software, viola il principio della <a 
 href="/activities/deviceneutrality/index">neutralità del 
 dispositivo</a>. Inoltre, è illegale quando i produttori non offrono ai 
 consumatori la possibilità di ottenere un rimborso per le licenze di 
 software non utilizzato.</p>
 <h3>È tempo di cambiare: unisciti all’iniziativa Refund4Freedom!</h3>
 <p>Insieme alla Italian Linux Society (ILS), la Free Software Foundation 
 Europe (FSFE) ha lanciato questa iniziativa per proteggere i diritti dei 
 consumatori nell’acquisto di nuovi computer. L’iniziativa Refund4Freedom 
 si propone di:</p>

 Aiutare i consumatori a ottenere il rimborso della licenza Windows quando acquistano un nuovo dispositivo;

 Fornire informazioni su come richiedere il rimborso ai produttori di dispositivi;

 Aumentare la consapevolezza contro la pratica del bundling obbligatorio del software nei dispositivi;
 </li>
 <li>
 Richiedere ai produttori politiche e procedure di rimborso più chiare ed efficaci;
 </li>
 <li>
 <div>Difendere il diritto dei consumatori di utilizzare solo il software di loro scelta.</div>
 </li>
 </ul>
 <h3>Esercitiamo la libertà del software insieme </h3>
 <p>
 La prossima volta che acquisti un computer con Windows preinstallato, 
 non esitare a unirti alla nostra iniziativa e a richiedere un rimborso! 
 Condividi con noi la tua esperienza: insieme, facciamo valere il nostro 
 diritto alla libertà del software!

 dispositivo"</em>, afferma Lucas Lasota, coordinatore di <strong 
 data-start="895" data-end="913">Refund4Freedom</strong>.
 </blockquote>
 <p></p>
 <h3>Rafforzare la libertà del software in tribunale</h3>
 <p>Refund4Freedom si ispira al lavoro instancabile di volontari che 
 affrontano grandi sfide per far valere i loro diritti e la libertà di 
 scelta del software. Un esempio è la storia di successo di Luca Bonissi, 
 sostenitore italiano della FSFE e sviluppatore professionista, che ha 
 intrapreso una battaglia legale contro il colosso dell’informatica 
 Lenovo nei tribunali italiani.</p>
 <p>La pratica di aumentare il prezzo dell’hardware includendo forzatamente 
 una licenza Windows preinstallata non è nuova, e a seconda del 
 produttore può trasformarsi in un processo lungo e frustrante. Nel 2018, 
 Luca ha presentato una richiesta a Lenovo per ottenere il rimborso del 
 costo della licenza di Windows e restituire il sistema operativo 
 preinstallato sul suo nuovo dispositivo convertibile Lenovo Thinkpad.</p>

 <p>Ciò che è iniziato come una semplice richiesta basata sui diritti del 
 consumatore si è trasformato in una lunga battaglia legale e burocratica 
 durata anni, con diversi procedimenti giudiziari, e ha richiesto a Luca 
 una notevole determinazione e resilienza. Alla fine, il giudice ha 
 riconosciuto il diritto al rimborso del software preinstallato e la 
 sentenza ha sottolineato che lo stesso produttore aveva espressamente 
 assunto questo obbligo nella licenza di Windows.</p>
 <p>Ma non è tutto: in una decisione storica, <a
 href="/news/2021/news-20210302-01.html">il tribunale
 ha imposto a Lenovo una sanzione pari a 20.000 euro per abuso
 delle procedure di ricorso</a>. Lenovo ha costretto il proprio cliente a 
 intraprendere un procedimento legale sproporzionato e inutile.</p>
 <p>Questa decisione ha segnato una significativa vittoria contro le 
 discutibili pratiche commerciali delle aziende tecnologiche, che 
 ostacolano i consumatori nel tentativo di ottenere un rimborso per il 
 software proprietario preinstallato. Tuttavia, ha anche messo in luce 
 una dura realtà: sebbene i consumatori abbiano legalmente diritto a un 
 rimborso, il costo e l’impegno necessari per far valere questo diritto 
 sono spesso molto elevati.</p>
 <p>Alcuni produttori hanno implementato politiche più chiare e procedure di 
 rimborso più semplici, come dimostrato da un altro <a 
 href="https://bonissi.it/bonissi_hp/">caso di successo avviato da Luca 
 contro HP</a> nel 2019. Tuttavia, per molti altri casi, i consumatori 
 sono costretti a impegnarsi in lunghe e persistenti comunicazioni con le 
 aziende e, in molti casi, a ricorrere a vie legali come ultima risorsa. 
 Queste aziende spesso sfruttano la loro posizione di forza per 
 scoraggiare i singoli utenti, consapevoli che molti non hanno tempo e 
 risorse sufficienti per avviare cause legali solo per ottenere il 
 rimborso di una licenza Windows.</p>
 <p>L'iniziativa <a href="https://refund4freedom.org/">Refund4Freedom 
 </a>documenta casi di successo in Italia e fornisce risorse pratiche per 
 aiutare gli utenti a esercitare i loro diritti e ottenere il rimborso. 
 Oltre a offrire strumenti concreti, l’iniziativa mira a garantire che i 
 consumatori non si sentano soli in questo percorso, fornendo loro 
 informazioni, guide e supporto per rivendicare il diritto a scegliere i 
 propri sistemi operativi, senza imposizioni.</p>
