<h2>Proteggere le licenze di Software Libero dalla bancarotta</h2>

Quando le aziende o gli autori che rilasciano il Software Libero vanno in

bancarotta, esiste un rischio che il Software Libero rilasciato con quelle
|
||
licenze debba affrontare problemi legali in alcune giurisdizioni. La

FSFE sta cercando di impedire questa situazione in Germania. Abbiamo
|
||
iniziato a discutere di questo problema durante un incontro con il
|
||
Ministro della Giustizia tedesco, che abbiamo incontrato grazie al <a
|
||
href="/news/2010/news-20100510-01.html">riconoscimento della Medaglia Theodor
|
||
Heuss</a>. Adesso ifrOSS, sostenuto dalla FSFE, suggerisce al Ministro della
|
||
Giustizia tedesco di <a

||
href="/news/2012/news-20120730-01.html">aggiungere una clausola relativa al
|
||
Software Libero nel codice fallimentare tedesco</a>. La clausola assicura
|
||
che il modello di licenza per il Software Libero non sia negativamente
|
||
condizionato dalla bancarotta di un titolare di diritti di licenza. Chiarisce
|
||
che ogni proposta di rilasciare licenze di Software Libero, offerta prima
|
||
della bancarotta del concedente, possa essere accettata da chiunque, anche
|
||
dopo l'inizio del procedimento fallimentare.
