<p>La FSFE ed il Samba Team (licenziatario delle informazioni
|
|
sull'interoperabilità, o "WSPP", attraverso il Protocol Freedom Information
|
|
Foundation) sono intervenuti nel caso negando che queste informazioni fossero
|
|
"innovative". L'unico valore legato alle informazioni era quello di permettere
|
|
una temporanea sostituzione dei servizi di rete, da creare attraverso la
|
|
scoperta di dettagli minori dei protocolli, quando i concetti generali, la
|
|
struttura e le decisioni tecniche erano ben comprese, e non erano innovative
|
|
se prese singolarmente, così come non era innovativa l'idea di combinarle. La Corte
|
|
ha sostenuto i rilievi della Commissione, considerando che: "La Microsoft
|
|
ha praticamente continuato a rifiutare agli sviluppatori di Software Libero
|
|
qualunque accesso alle informazioni relative all'interoperabilità, il
|
|
che non era riconosciuto dalla lettera in parola come facoltà legittima".</p>
