  11. The European Commission is on the verge of settling two antitrust
  12. cases against Microsoft. The details of this settlement will determine
  13. how much competition there can be in Europe's software market for
  14. years to come.

  17. The Free Software Foundation Europe has analysed the most important
  18. elements that a settlement should contain to allow real competition in
  19. the European software market. It has summarised those key points in a
  20. letter sent to Competition Commissioner Neelie Kroes:

  26. Kroes is looking at Microsoft's practice of tying its Internet
  27. Explorer browser to its Windows operating systems, excluding rival
  28. browser makers. She is also trying to persuade Microsoft to release
  29. enough information so that competitors can make their desktop software
  30. work with the company's dominant operating system. This is something
  31. that Microsoft has refused to do in the past.

  34. FSFE believes that a settlement on the browser case needs to put rival
  35. browsers on an equal footing with Microsoft's Internet Explorer by
  36. pre-installing them. Fast-growing browsers need to be included in an
  37. unbiased selection screen.

  40. For desktop applications, FSFE argues that the software monopolist
  41. must release interoperability information in such a way that it can be
  42. used in Free Software. The company must also make a binding commitment
  43. not to enforce its patents against Free Software. That would prevent
  44. Microsoft from using Fear, Uncertainty and Doubt (FUD) to keep rivals
  45. from making use of the information.
