<p newsteaser="yes">This month has been full of activity, but one bit of news has cast a
shadow over it all. We have learned of the death of Richard Rothwell,
who was a prominent and respected advocate for Free Software in
education and a Fellow. We are saying farewell to him below.</p>
<p>Major activities of the month were: the support of our German Chapter
to OpenRuhr initiative, the participation to a Conference hosted by
the WIPO, an interesting Fellowship meeting in Berlin, our presence to
RMLL in Nantes, and the publishing of our statement about the latest
developments in the EU browser case.</p>

<h3><a name="1"/>Fresh air at WIPO, but old habits die hard</h3>
<p>On the 13 and 14 July, in Geneva, the World Intellectual Property
Organization (WIPO) hosted the Conference "Intellectual Property and
Public Policy Issues" with the aim of reflecting on the consequences of
the policies that WIPO promotes. Karsten Gerloff, FSFE's president,
attended the event and wrote an extensive report: "Fresh air at WIPO,
but old habits die hard". He highlights that the event in itself was a
very positive step for the organisation, which is starting to pay
attention to the real-world impact of the policies it develops. Still,
some troubling old mistakes remain.</p>

<h3><a name="2"/>A farewell to Richard Rothwell</h3>
<p>It is with sorrow that we pay our respect to Richard Rothwell. A
Fellow, a brilliant activist and a key figure in the UK Free Software
community. On 17 July, Richard passed away, tearing a hole in the
network of the Free Software movement which will be difficult to
fill. We want to remember him here, and to offer our condolences to
Richard's family and closest friends.</p>

<h3><a name="3"/>FSFE supports OpenRuhr</h3>
<p>Our German chapter has decided to support the OpenRuhr initiative.
During 2010 in the Ruhr area the 'cultural cities' will set facilities
and plan events which will promote Free Software as a cultural technique
for creative people in their works. Our German chapter aims at
developing informative material to portray Free Software as a cultural
technique.</p>

<h3><a name="4"/>FSFE booth at RMLL Nantes, France, 07-11 July</h3>
<p>Rainer Karsten and Michel Roche manned our booth at the 10th
"Rencontres Mondiales du Logiciel Libres" (RMLL), which took place in
Nantes. RMLL is the most important Free Software event in France with
some 5000 visitors. Rainer and Michel had a very busy four days
explaining the basics of Free Software, and telling a large number of
people about FSFE's work.</p>

<h3><a name="5"/>Fellowship Meeting in Berlin, 09 July</h3>
<p>The Berlin Fellowship group met on 9 July at the Newthinking Store, at
Tucholskystrasse 48. On the meeting's agenda was an interesting debate
with representatives of youth organisations of various political
parties. Members of the Junge Union Brandenburg, Jungen Liberalen
Brandenburg, Grüne Jugend, Piratenpartei, and SDS.Berlin presented
their views about Free Software issues and answered questions from
other participants. Lena Simon recorded the event, which we will
publish shortly on our Fellowship platform.</p>

<h3><a name="6"/>The Fellowship interviews: Smári McCarthy</h3>
<p>This month, Stian Rødven Eide interviewed Smári McCarthy: a thoughtful
anarchist and practical chaos technician with a deep interest in Free
Software and democracy. The interview addressed various aspects of
Smári's life from his work at the Fab Lab, to the Icelandic Society for
Digital Freedoms, concluding with his views on a "crowdsourced
democracy".</p>

<h3><a name="7"/>EU browser case: FSFE says details of settlement will be crucial</h3>
<p>In 2007, Opera Software presented the European Commission with a formal
complaint regarding Microsoft's tying of Internet Explorer (IE) to its
operating systems. We decided to follow the development of this issue
and we officially offered our help as interested third party to the
Directorate General for Competition.</p>
<p>On January 2009, the European Commission DG Competition issued a
statement of objections against Microsoft which recently led the
company to consider a settlement. While the offer of a settlement is
an important achievement for the European Commission, we believe that
it is the details which will make all the difference. A settlement
that simply looks good will not be enough. We need to be sure that any
agreement between Microsoft and the Commission really puts Free
Software on an equal footing with proprietary competitors, and allows
for free competition in the web browser market.</p>

<h3><a name="8"/>FSFE supporting European Commission in their case against Microsoft</h3>
<p>Five years ago, Microsoft appealed against the European Commission
antitrust decision. The Directorate General for Competition called for
cooperation upon FSFE and Samba. A call that we did not miss: on 27
July 2004 we had already participated to the preliminary hearing of
the appeal in Luxembourg. That was the beginning of what would become
the greatest success for FSFE and for Free Software in the legal field
in 2007, when Microsoft was ordered by the European Court of First
Instance to share interoperability information with the Samba team.</p>

Le mois dernier fut débordant d'activité, mais a été terni par une
bien triste nouvelle. En effet, nous avons appris le décès de Richard
Rothwell, partisan des Logiciels Libres connu et respecté dans le
milieu de l'enseignement, et Fellow. Nous lui faisons nos adieux
ci-après.</p>
<p>Ce mois-ci, nous nous sommes principalement attachés à soutenir la
délégation allemande à l'OpenRuhr, à participer à une conférence de l'OMPI
ainsi qu'à une rencontre enrichissante de la Fellowship à Berlin, tout
en étant présents aux RMLL de Nantes et avons publié un communiqué
concernant les derniers développements du dossier européen des navigateurs
Internet.</p>

<h3><a name="1"/>Du sang neuf à l'OMPI, mais les usages sont coriaces</h3>
<p>Les 13 et 14 juillet, l'Organisation mondiale de la propriété intellectuelle
(OMPI) a tenu à Genève un congrès sur « la propriété intellectuelle et les
politiques publiques ». La réflexion a porté sur les effets des politiques
soutenues par l'OMPI. Karsten Gerloff, président de la FSFE, y a participé
et a rédigé un rapport conséquent intitulé <i>Du sang neuf à l'OMPI, mais
les usages sont coriaces</i> (<i>Fresh air at WIPO, but old habits die hard</i>)
Il met en exergue le pas en avant apporté par l'évènement en lui-même, car
l'organisation commence à prêter attention aux impacts de ses politiques sur
le monde réel. Cependant, quelques anciennes bévues demeurent...</p>

<h3><a name="2"/>Adieux à Richard Rothwell</h3>
<p>C'est avec tristesse que nous saluons Richard Rothwell. Un Fellow, un
activiste brillant et une figure clé de la communauté anglo-saxonne du
Logiciel Libre. Ce 17 juillet, Richard s'en est allé, laissant un trou
dans le réseau du mouvement du Logiciel Libre qui sera difficile à
combler. Nous voulons nous souvenir de lui, et présentons nos sincères
condoléances à sa famille et à ses proches.</p>

<p>Notre délégation nationale allemande a décidé de soutenir
l'initiative OpenRuhr. Tout au long de l'année 2010, les « villes
culturales » de la région de la Ruhr mettront à disposition des
infrastructures et programmeront des évènements qui promouvront les
Logiciels Libres comme technique culturale au service des artistes.
Notre délégation allemande veut concevoir des supports d'information
pour décrire le Logiciel Libre comme technique culturale.

<h3><a name="4"/>Stand de la FSFE aux RMLL de Nantes, du 7 au 11 juillet</h3>
<p>Rainer Karsten et Michel Roche ont tenu notre stand aux dixièmes
Rencontres mondiales du Logiciel Libre (RMLL) à Nantes. Il s'agit de
la manifestation la plus importante en France concernant les Logiciels
Libres, avec quelque 5 000 visiteurs. Rainer et Michel ont été très
occupés durant ces quatre jours, expliquant sans relâche les fondamentaux
des Logiciels Libres, et instruisant de nombreuses personnes sur le travail
mené par la FSFE.</p>

<p>Le groupe de la Fellowship de Berlin s'est réuni le 9 juillet au

avec les délégués de partis politiques et de mouvement de la jeunesse
était inscrit à l'ordre du jour. Les membres de la «Junge Union Brandenburg»,

point de vue sur les problématiques liées aux Logiciels Libres et ont

<h3><a name="7"/>Dossier de l'UE sur les navigateurs Internet&#160;: les details de
l'accord seront cruciaux</h3>
<p>En 2007, la compagnie de logiciels Opera Software a déposé plainte auprès de
la Commission Européene contre la vente liée opérée par Microsoft entre Internet
Explorer (IE) et son système d'exploitation Windows. Nous avons dès lors décidé
de suivre le cours de cette affaire et avons officiellement proposé notre aide comme
tiers participant à la Direction générale de la concurrence.</p>
<p>En janvier 2009, la Direction générale de la concurrence de l'Union a effectué
une communication des griefs à Microsoft, ce qui a récemment conduit l'entreprise
à considérer un arrangement. Tandis que la proposition d'un arrangement est une
avancée majeure pour la Commission, nous croyons que ce sont ses détails qui feront
toute la différence. En effet, un accord qui semble bon ne sera pas suffisant. Nous
devons nous assurer qu'un quelconque accord entre Microsoft et la Commission mette
les Logiciels Libres sur un pied d'égalité avec les concurrents propriétaires, et
permette une concurrence non faussée sur le marché des navigateurs Internet.</p>

<h2>Un regard sur le passé</h2>

<p>Il y a cinq ans, Microsoft faisait appel de la décision antitrust de la
Commission Européenne. La Direction générale de la concurrence lui demandait
de coopérer avec la FSFE et Samba. Une demande qui ne nous avait pas échappé&#160;: le 27
juillet 2004, nous avions déjà pris part aux auditions préliminaires à l'appel
à Luxembourg. C'était le commencement de ce qui deviendrait, en 2007, le plus
grand succès de la FSFE et des Logiciels Libres dans le domaine juridique&#160;:
Microsoft reçut l'injonction du Tribunal de première instance de la Cour
européenne de justice, de partager les informations d'interopérabilité avec
l'équipe de Samba.</p>

<p newsteaser="yes">Questo mese è stato pieno di attività, ma una notizia in particolare ha
gettato ombra su tutto. Abbiamo appreso della morte di Richard Rothwell, un'attivista di
rilievo e rispettato per il Software Libero nell'ambito educativo ed un Fellow.
Gli porgeremo il nostro addio qui sotto.</p>
<p>Le principali attività del mese sono state: il supporto all'iniziativa OpenRuhr da
parte del nostro team tedesco, la partecipazione ad una Conferenza ospitata da WIPO,
un interessante incontro dei Fellow di Berlino, la nostra presenza all'RMLL in Nantes,
e la pubblicazione della nostra posizione a riguardo degli ultimi sviluppi nel caso Europeo
dei browser.</p>

<p>Il 13 e 14 Luglio a Ginevra, la World Intellectual Property

L'RMLL è l'evento sul Software Libero più importante della Francia con circa
5000 visitatori. Rainer e Michel hanno avuto una quattro giorni veramente intensa nello
spiegare le basi del Software Libero e nel parlare a numerose persone del nostro lavoro.</p>

<h3><a name="7"/>Il caso UE sui browser: FSFE sostiene che i dettagli dell'accordo saranno cruciali</h3>
<p>Nel 2007, Opera Software ha presentato alla Commissione Europea un reclamo formale
sulla pratica di Microsoft di legare Internet Explorer (IE) al proprio sistema operativo.
Abbiamo deciso di seguire gli sviluppi della questione e abbiamo ufficialmente offerto il nostro
supporto in qualità di terze parti interessate al Direttorato Generale (DG) per la Competizione.</p>
<p>Nel Gennaio 2009, il DG per la Competizione della Commissione Europea ha emesso uno
statement of objections contro Microsoft che ha recentemente spinto la compagnia a considerare
un accordo legale. Mentre l'offerta di un accordo è un importante successo per la Commissione Europea,
riteniamo che siano i dettagli che faranno tutta la differenza. Un accordo che sembra semplicemente
buono non sarà sufficiente. Dobbiamo assicurarci che qualsiasi accordo tra la Commissione e Microsoft
metta veramente il Software Libero allo stesso livello dei concorrenti proprietari e che permetta libera

<p>Cinque anni fa, Microsoft si è appellata contro la decisione antitrust della Commissione Europea.
Il DG per la Competizione ha chiesto la nostra cooperazione e quella di Samba. Una richiesta che non ci
siamo lasciati scappare: il 27 Luglio 2004 avevamo già partecipato all'udienza preliminare dell'appello
in Lussemburgo. Quello era l'inizio di ciò che sarebbe diventato, nel 2007, il più grande successo per
FSFE e per il Software Libero in campo legale, quando a Microsoft venne obbligata dalla Corte di
Prima Istanza della Commissione Europea a condividere le informazioni per l'interoperabilità con il
team Samba.</p>

in het onderwijs is overleden. Wij nemen even verder graag
afscheid van hem.

Belangrijke activiteiten van de afgelopen maand: onze Duitse
afdeling ondersteunt het OpenRuhr initiatief, deelname aan een
conferentie georganiseerd door WIPO, een leerzame
Fellowshipvergadering in Berlijn, onze vertegenwoordiging op

Een nieuwe wind waait door WIPO, maar oude gewoontes verdwijnen

Op 13 en 14 juli organiseerde de World Intellectual Property
Organization (WIPO) in Genève de conferentie "Intellectual
Property and Public Policy Issues". Er werd nagedacht over de
gevolgen van het beleidsadvies dat WIPO promoot. Karsten
Gerloff, voorzitter van de FSFE, was aanwezig en schreef een
uitvoerig rapport: "Fresh air at WIPO, but old habits die hard".
Hij benadrukt dat het hele evenement een grote stap voorwaarts
is voor de organisatie. Men krijgt stilaan aandacht voor de
gevolgen van hun beslissingen in de echte wereld. Maar enkele
verontrustende oude fouten blijven bestaan.</p>

Afscheid van Richard Rothwell
</h3>
<p>
Met pijn in ons hart nemen wij afscheid van Richard
Rothwell. Een Fellow, een uitmuntende activist en een
sleutelfiguur in de Britse Vrije Softwaregemeenschap. Op 17 juli
overleed Richard. Het zal niet makkelijk zijn om de leegte die
hij in deze gemeenschap achterlaat op te vullen. Wij willen hem
hier gedenken en ons medeleven betuigen aan zijn familie en
vrienden.

De FSFE ondersteunt OpenRuhr
</h3>
<p>
Onze Duitse afdeling heeft beslist om het OpenRuhr initiatief te
ondersteunen. In 2010 zullen de 'culturele steden' uit het
Ruhrgebied faciliteiten aanbieden en evenementen organiseren die
Vrije Software zullen voorstellen als een culturele techniek
voor creatieve mensen en hun werken. Onze Duitse afdeling wil
informatief materiaal ontwikkelen waarin Vrije Software wordt
voorgesteld als culturele techniek.

Een FSFE-stand tijdens RMLL Nantes, Frankrijk, 07-11 juli

<p>
Rainer Karsten en Michel Roche organiseerden onze stand op de
10de "Rencontres Mondiales du Logiciel Libres" (RMLL), die plaats
vond in Nantes. RMLL is het belangrijkste Vrije
Software-evenement in Frankrijk met meer dan 5000
bezoekers. Rainer en Michel hebben vier drukke dagen gehad met
het uitleggen van de basisprincipes van Vrije Software en vele
bezoekers te informeren over de activiteiten van de FSFE.

Fellowshipvergadering in Berlijn, 9 juli
</h3>
<p>
De Berlijnse Fellowshipgroep kwam op 9 juli samen in de
Newthinking Store, Tucholskystrasse 48. Er stond een interessant
debat op de agenda met vertegenwoordigers van de
jongerenorganisaties van verschillende politieke partijen. Leden
van de Junge Union Brandenburg, Jungen Liberalen Brandenburg,
Grüne Jugend, Piratenpartei en SDS.Berlin gaven hun mening over
Vrije Software en beantwoordden vragen van de andere
deelnemers. Binnenkort zullen de opnamen die Lena Simon van het
evenement maakte op het Fellowshipplatform gepubliceerd
worden.

Het Fellowshipinterview: Smári McCarthy
</h3>
<p>
Stian Rødven Eide interviewde deze maand Smári McCarthy: een
peinzend anarchist en een praktisch chaotische technicus met een
sterke interesse in Vrije Software en democratie. We spraken met
Smári over verschillende aspecten van zijn leven: zijn werk in
het Fab Lab, de IJslandse vereniging voor digitale vrijheid en
we eindigen met zijn persoonlijke mening over een "crowdsourced
democracy".

EU browserzaak: Voor de FSFE zijn de details van de schikking
van cruciaal belang
</h3>
<p>
In 2007 diende Opera Software een formele klacht in bij de
Europese Commissie. Ze gingen niet akkoord met de praktijk van
Microsoft om hun Internet Explorer (IE) vast te linken aan hun
besturingssysteem. Wij hebben besloten om de ontwikkelingen in
deze zaak van nabij te volgen en hebben officieel onze hulp
aangeboden aan het Directoraat-generaal voor Concurrentie als
belanghebbende derde partij.
</p>
<p>
Op 29 januari 2009 heeft het DG concurrentie van de Europese
Commissie een mededeling van punten van bezwaar tegen Microsoft
bekendgemaakt. Als gevolg overweegt dit bedrijf een schikking te
treffen. Het aanbod tot een schikking is al een belangrijke
verwezenlijking voor de Europese Commissie. Maar volgens ons
zullen de details van deze schikking het succes ervan
bepalen. Een schikking die er goed uitziet is niet
voldoende. Wij willen garanties dat de overeenkomst tussen
Microsoft en de Commissie ervoor zorgt dat Vrije Software op
gelijke voet behandeld wordt als de propriëtaire concurrenten en
een volledig vrije concurrentie in de browsermarkt toelaat.

De FSFE steunt de zaak van de Europese Commissie tegen Microsoft
</h3>
<p>
Vijf jaar geleden tekende Microsoft beroep aan tegen de
beslissing van de Europese Commissie in de antitrustzaak. Het
Directoraat-generaal voor concurrentie vroeg voor samenwerking
met FSFE en Samba. Een vraag die wij niet lieten passeren: op 27
juli 2004 hadden we al deelgenomen aan de inleidende
hoorzittingen voor het beroep in Luxemburg. Dit vormde de basis
voor één van de grootste overwinningen van de FSFE en Vrije
Software op juridisch gebied in 2007. Microsoft werd toen door
het Gerecht van eerste aanleg van de Europese Gemeenschappen
verplicht om alle gegevens die nodig waren om interoperabiliteit
te verzekeren bekend te maken aan het Samba-team.
