FTF: Freedom Task Force

The Free Software Legal and Licensing Workshop

The Free Software Legal and Licensing Workshop is held every year to allow legal experts to discuss issues and best practices surrounding Free Software licences. This event has become the world’s foremost gathering of lawyers, technologists and thought leaders on Free Software legal and licensing topics. With up to three days of talks in an informal and confidential atmosphere, the Workshop advances the state of the art of knowledge on topics ranging from licence compliance to patent management, from project governance to corporate responsibility and even further to the cutting edge issues themselves.

Participation to the Free Software Legal and Licensing Workshop provides legal professionals not only the opportunity to share knowledge and updates on the topics they are working on, but also a chance to meet and get acquainted with each other. These two aspects, combined, foster better licence compliance by spreading best practices. The conference also provides a forum for different professionals to better understand each other, thus reducing the overall friction in the sector.

Participation to the event is open to all Legal Network members.
The Free Software Legal and Licensing Workshop 2016

The last Legal Network Conference was held on the 13, 14 and 15 of April 2016, in Barcelona, Spain.

Backed up by the feedback and experience we collected in the past few years, we decided to continue with the trend of addressing important challenges. What we saw recently is that the situation is becoming more and more complex and that it is high time we do something about it. This is why the motto for 2016 was:
Simplify

Some of the topics we discussed were:

NGOs for Free Software:
Proposals and new ideas on legal structures for Free Software projects

Important non-software cases:
Some cases that were not about software, but can impact how copyright on software is applied by courts

Tooling:
The best tools to support and manage Free Software compliance

Working together:
How collaborating on various issues can make everything simpler

Enforcement and compliance:
Are the efforts towards enforcement making Free Software stronger?1

The Free Software Legal and Licensing Workshop 2016

Date and Venue

The next European Legal Network Conference will be held on the 13, 14
and 15 of April 2016, in Barcelona, Spain. Please be aware that some
other major events will be held in the city at the same time,
therefore we highly recommend that you book your hotel early in order
to secure a good price.

The Free Software Legal and Licensing Workshop 2015

In 2015 the workshop took place, once again, in Barcelona on 16-17 April, receiving more than 90 experts from all around the world. Instead of rehashing familiar topics, we looked at what problems we will likely encounter in the next five to ten years. Each day we had two topics to spur interesting debate in the room as well as the hallway. As always, the workshop was held under the Chatham House Rule, to encourage an open and unencumbered debate.

Topics

In 2015 we held a pre-event on 15 April, called the Open* Day, to explore topics beside software. In particular:

Recent events and cases:
Updates on patent, copyright and data mining cases

Plug-in licence for patents:
Some proposals on how to add patent licensing clauses to older licences.

Research standards and their Free Software implementation:
Exploring the relationship between standards, Free Software and their impact on public administrations and public procurement.

Openness - encouragement or compulsion?
Discussing the advantages and disadvantages of different degrees of openness, considering also different legal tools to enforce it.

EU public sector, information and privacy:
An overview on how those critical aspects of EU legislation interact with each other. How should they be balanced?

Registration

This is an invite-only event. If you wish to inquire about tickets,
please send an e-mail to

Rules for the Legal Network

The Legal Network fosters a productive, cooperative discourse in a private setting, enabling the members to discuss legal questions away from contentious public debate. To be true to this objective, participants should be free to express bold, innovative ideas while feeling safe from judgement and personal attacks.

During the several years in which the Legal Network existed, a set of rules and practices has emerged and evolved according to its increasing size. Some of these became crucial to allow the discussions to be productive, others are simply good practices that facilitate our work. For transparency and ease of access we have collected them all here, grouped in substantial regulation and procedures.

Behaviour on the Legal Network

To ensure that freedom of expression and peace of mind are available to all those engaging in the discussions, the Legal Network requires their members to abide to its Code of Conduct. To allow participants a greater degree of independence and encourage them to propose bold ideas, any communication is also protected by the Chatham House Rule.

The inability to comply with the following rules, assessed by the Legal Team, can result in sanctions.

The Legal Network Code of Conduct

The Legal Network and its associated events are intended for professional non-partisan networking and collaboration in the Free Software community. Participants are expected to behave with courtesy and according to professional standards suitable for the widest international audience. Participants should at all times feel at ease expressing their own opinions on any relevant subject they feel is worth being considered by other members, without fearing any form of attack, reprisal or harassment.

While on the FSFE IT infrastructure made available for the Legal Network (e.g. mailing lists, wiki) and at its events or related professional or social networking opportunities, participants shall not engage in discriminatory, disparaging or offensive speech or actions, including as to gender, sexuality, race, nationality, religion or profession, and in particular regarding any other member of the Network. Speakers should be especially aware of these concerns.

Neither the FSFE nor the Legal Network tolerate or condone any statements or actions by participants contrary to these standards. The FSFE’s Legal Team reserves the right to deny entrance and/or eject from an event (without refund) or its IT infrastructure (e.g. mailing lists, wiki) any individual whom it considers to be in breach of this code of conduct, even in private settings or non-Legal Network media such as blogs or public forums, when related to discussions that happened on the Legal Network or at its events, or in relation to its members as such.

Please bring any concerns to the immediate attention of the Legal Team, at legal@lists.fsfe.org detailing the events and possibly providing a reference to any recording1 of the facts.

Unless explicitly otherwise stated for specific communication or where the relevant parties agree to being identified, the Legal Network and its associated events are held under the Chatham House Rule2. Participants are free to use the information received, but neither the identity nor the affiliation of the speaker(s), nor that of any other participant, may be revealed.

Procedures for the Legal Network

Several procedures are in place to report breaches of the regulations, joining the Legal Network or creating additional groups.

Joining the Legal Network

Given the high level of confidentiality of some discussions, admission to (and continued membership in) the Legal Network is subject to the approval of the FSFE’s Legal Team and depends on the respect of the Legal Network regulations.

Successful applicants will have profound expertise in legal matters pertaining to Free Software, and will join the Network in order to share their knowledge with their peers from around the world. While some members are indeed affiliated with prominent companies or organisations, this does not constitute a factor in assessing membership, which is awarded on a personal basis.

The Legal Network thrives in the diversity of its members. As such, there is a particular interest in welcoming new experts from the geographical areas that are currently under-represented (i.e. Eastern European countries, the Baltic states, Asia, South America and Africa).

Traditionally, a new member is presented to the FSFE’s Legal Team by a Legal Network Member, but any presentation email will be considered.

If you intend to join or to propose someone as a Legal Network member, please write to our Legal Team Coordinator detailing:

Full name

Email address to be used for Legal Network communications

Background and current activities

Proposing Legal Network member (if available)

At regular intervals, the Legal Team Coordinator presents the proposed new members to our Legal Team. The Legal Team then decides on the admission of the new members through a vote.

Once the Legal Team has reached its decision, the proposed members are contacted by the Legal Team Coordinator by email and asked to formally accept the Legal Network regulations before adding them to the mailing list.

Creating a Special Interest Group

Any member of the Legal Network can propose the creation of a Special Interest Group on a new topic by simply contacting the Legal Team Coordinator or by declaring such interest directly on the Legal Network

Breaches of regulation

The respect of the Code of Conduct and the Chatham House Rule is ensured by FSFE’s Legal Team. Please report breaches as soon as they happen, so that we can take the appropriate measures. Depending on the gravity of the breach and its circumstances, the Legal Team will decide what sanction to apply (e.g. simple warning, moderation period, expulsion from the Legal Network).

The Structure of the Legal Network

The Legal Network was originally a single mailing list. Over the years the needs of the group have changed and brought to the creation of additional groups that make the participation in the Network easier and more productive.

The Legal Network mailing list

The core activities of the Legal Network happen through the main mailing list. There the Legal Network members can communicate with each other, ask their questions, propose discussions and test their ideas freely, inside the boundaries defined by the Legal Network Code of Conduct, the Chatham House Rule and the general netiquette.

The Special Interest Groups

The Special Interest Groups (SIGs) are created when a number of members feels like a topic deserves special attention. SIGs have their own separate mailing lists and a dedicate Chairman that leads the discussion. Every activity of the SIGs is subject to the same regulations of the Legal Network. Due to their extremely specific topics, SIGs can invite non-LN members to join; such members will not have access to the Legal Network main discussions.

The creation of SIGs is discussed among the other Legal Network procedures.

The Mentors of the Legal Network

The Mentors mailing list1 is an additional list that has been designed to help new members participate in the discussion. Members of the Legal Network that have a question but are unsure wether it is relevant or if it has been asked before, can contact mentors.ln@lists.fsfe.org; a small group of expert members of the Legal Network will receive the request and reply in private.

The Council of the Legal Network

The Council of the Legal Network has been created to help the Legal Team with managing the Legal Network by providing the advice of expert members. It operates with a collaborative attitude and takes into account input from various sources, including the interested parties, prominent members of the Legal Network and the FSFE.

The Council is consulted on the prospective evolution of the Legal Network and operates as an advisory board for the decisions taken by the Legal Team.

The role of the FSFE

The FSFE acts as a facilitator for the Legal Network, providing technical infrastructure and coordination support. The day-to-day operations on the Legal Network are performed by the FSFE’s Network Coordinator, with the support of the FSFE’s Legal Team.

Regardless, the Legal Network maintains its independence and the opinions expressed there do not necessarily reflect the position of the FSFE. The FSFE will not intervene to push the Legal Network towards a specific position and reserve its right to take different stances.

The Legal Network

The Legal Network1 is a neutral, non-partisan, group of experts in different fields involved in Free Software legal issues. Currently the Legal Network has over 400 participants from different legal systems2, academic backgrounds3 and affiliations4.

The aim of the Legal Network is to promote discussion and foster better knowledge of the legal constructs that back Free Software. The conversations on the Legal Network are intended to be dynamic, thought-provoking and up to speed with the most recent developments.

Providing a neutral place of discussion allows the Free Software community at large to grow along various axes. Most prominently, the Legal Network parses possible complications that may arise with Free Software before they emerge in the legal practice. Consequently it develops solutions and tries to build consensus around them in the legal community. Members of the Legal Network also use it to improve each other’s expertise in those fields in which they are less well-versed, contributing to the improvement of the best legal experts on Free Software.

The discussions of the Legal Network are held in a private mailing list. Through the Free Software Legal and Licensing Workshop, the Legal Network provides a catalyst for such activities, giving its members a chance to meet in person, present their works and ideas and get immediate feedback.

Admission to the Legal Network is restricted, and the discussions held there are confidential. Regardless, this does not lock the content away from the larger Free Software community, as the Chatham House Rule enables members to spread the content of the conversations at fair conditions.

Furthermore, when a topic that requires more in-depth analysis arises, the Legal Network sets up a Special Interest Group (SIG). SIGs are subject to the same Code of Conduct as the Legal Network, but can invite experts from outside the Network if their input is deemed valuable. When the discussion on the original question has reached maturity, the SIG presents its output to the wider community.

<!--

The Legal Network occasionally produces public documentation to help people explore and understand legal matters. These are discussion documents and the contents do not constitute legal advice or necessarily reflect the opinions of any contributor, or the FSFE’s own positions. You can find out more about these documents on the Legal Network public wiki.

A Rede Jurídica Europeia

<localmenu/>

FSFE makes a specialised copyright assignment document called the
