<p>Am 14.08.2025 ist die Bundesregierung 100 Tage im Amt. Im
|
||||
Koalitionsvertrag hatten CDU, CSU und SPD ambitionierte Ziele für Freie
|
||||
Software angekündigt. Doch bisher ist unklar, welche Ziele dies konkret
|
||||
sind, wie sie erreicht werden sollen und welche Rolle Freie Software
|
||||
künftig für Deutschlands technologische Souveränität spielt.</p>
|
||||

<p>Im Februar <a href="/news/2025/news-20250206-01.html">hat die Free
|
||||
Software Foundation Europe (FSFE) gefordert</a>,
|
||||
nach der Bundestagswahl endlich die Kontrollierbarkeit, Sicherheit und
|
||||
Souveränität öffentlicher digitaler Infrastrukturen zur Priorität zu
|
||||
machen und dabei konsequent auf Freie Software (auch als Open Source
|
||||
bekannt) zu setzen. Die damaligen FSFE-Kernforderungen: <a href="https://publiccode.eu/de">„Public Money?
|
||||
Public Code!“</a>, eine sichere, langfristige Finanzierung für Freie
|
||||
Software, Kompetenzaufbau und Statistiken zum Fortschrittsmonitoring.
|
||||
Wir brauchen einen echten Aufbruch, damit <a
|
||||
href="/news/2025/news-20250103-01.html">die Zukunftsvision von „Public
|
||||
Money? Public Code!“ zur Realität wird:</a> Öffentliche Mittel sollen in
|
||||
Zukunft ausschließlich für Freie Software genutzt werden.</p>
|
||||
|
||||
<p>100 Tage nach dem Amtsantritt der neuen Regierung ist es nun Zeit,
|
||||
eine erste Bilanz zu ziehen.</p>
|
||||
|
||||
<h3>Vergabereform: Freie Software muss vorrangig beschafft werden</h3>
|
||||
<p>Erst vor wenigen Tagen, am 06. August 2025, verabschiedete das
|
||||
Bundeskabinett den Entwurf für ein Gesetz zur Beschleunigung der Vergabe
|
||||
öffentlicher Aufträge mit dem Ziel, Vergabeverfahren effizienter,
|
||||
flexibler und digitaler zu gestalten. Der Entwurf sieht zwar vor,
|
||||
„Belange der digitalen Souveränität“ als Kriterium bei Ausschreibungen
|
||||
zu ermöglichen. Doch die Chance, die Beschaffung Freier Software für
|
||||
öffentliche Verwaltungen zu priorisieren und zu vereinfachen, wurde
|
||||
nicht genutzt. Es ist jetzt an den Regierungsfraktionen im Bundestag,
|
||||
den Entwurf nachzubessern.</p>
|
||||
|
||||
<p><strong>Die FSFE fordert:</strong> Das Prinzip „Public Money? Public Code!“ muss sich
|
||||
künftig in der öffentlichen Vergabe wiederfinden, indem dort ein Vorrang
|
||||
für Freie Software verankert wird. Nur so lässt sich die strukturelle
|
||||
Abhängigkeit öffentlicher Verwaltungen von proprietärer Software und
|
||||
ihren Herstellern beenden und technologische Souveränität erreichen.
|
||||
Zudem sollte die Regierung öffentliche Verwaltungen verpflichten, den
|
||||
Anteil Freier Software an aller beschafften, beauftragten oder
|
||||
entwickelten Software regelmäßig zu erfassen und zu veröffentlichen.
|
||||
Dadurch lassen sich Fortschritte messbar machen und Fehlentwicklungen
|
||||
erkennen.</p>
|
||||
|
||||
<h3>„Deutschland-Stack“: Nationaler Alleingang statt europäischer
|
||||
Zusammenarbeit?</h3>
|
||||
|
||||
<p>Bis zum Jahr 2028 will die Bundesregierung einen „Deutschland-Stack“
|
||||
veröffentlichen – laut Bundesdigitalminister Karsten Wildberger eine
|
||||
einheitliche IT-Architektur mit Basiskomponenten wie Cloud-Software und
|
||||
klar definierten Schnittstellen. Doch die Entwicklung eines nationalen
|
||||
IT-Stacks ist ein Irrweg. Stattdessen sollten die europäischen
|
||||
Mitgliedstaaten als Partner auf eine gemeinsame Beschaffung und
|
||||
Entwicklung hinarbeiten – mit Schwerpunkt auf Interoperabilität und dem
|
||||
Austausch von Lösungen, ohne das Rad immer wieder neu zu erfinden. Ohne
|
||||
EU-weite Abstimmung und Kollaboration droht der Stack zu
|
||||
einem isolierten Projekt zu werden.</p>
|
||||
|
||||
<p>Zudem ist offen, ob der Stack überhaupt als Freie Software entwickelt
|
||||
wird. Auch an Transparenz mangelt es: Bei einer ersten,
|
||||
nichtöffentlichen Präsentation des Zwischenstands Anfang Juli blieben
|
||||
Vertreter aus der Zivilgesellschaft, Freie-Software-Projekten und ihren Communities außen
|
||||
vor.</p>
|
||||
|
||||
<p><strong>Die FSFE fordert:</strong> Die Bundesregierung muss bei der Entwicklung eines
|
||||
IT-Stacks europäisch denken und handeln, indem sie mit europäischen
|
||||
Partnern an einem gemeinsamen Stack arbeitet, anstatt Ressourcen in
|
||||
einen fragwürdigen nationalen Alleingang zu investieren. In jedem Fall
|
||||
muss das Bundesministerium für Digitalisierung und Staatsmodernisierung
|
||||
(BMDS) konsequent auf Freie Software und offene, mit Freier Software
|
||||
kompatible Standards setzen, damit eine echte Alternative zu
|
||||
proprietären Produkten entsteht. Die Zivilgesellschaft und
|
||||
Freie-Software-Wirtschaft müssen von Anfang an einbezogen werden. So
|
||||
kann vorhandene Expertise genutzt, Akzeptanz geschaffen und ein echter
|
||||
Wandel im Sinne technologischer Souveränität eingeleitet werden: im Bund
|
||||
ebenso wie in Ländern, Kommunen und in der gesamten Gesellschaft in
|
||||
Deutschland und Europa.</p>
|
||||
|
||||
<h3>Bundeshaushalt: Freie Software fehlt langfristige finanzielle
|
||||
Sicherheit</h3>
|
||||
<p>Auch nach der Vorstellung des Bundeshaushalts 2025 und der
|
||||
Haushaltsdebatte im Deutschen Bundestag bleibt unklar, wie Freie
|
||||
Software langfristig finanziell abgesichert werden soll. Eine
|
||||
strategische Umschichtung der opulenten Ausgaben für proprietäre
|
||||
Lizenzen hin zu Freier Software im Sinne von „Public Money? Public
|
||||
Code!“ zeichnet sich bisher nicht ab. Auch die Budgets für die
|
||||
Freie-Software-Initiativen des Bundes bleiben prekär: Für sie sind
|
||||
bisher im Einzelplan des Bundesinnenminsteriums viel zu geringe Mittel
|
||||
vorgesehen.</p>
|
||||
|
||||
<p><strong>Die FSFE fordert:</strong> Die Bundesregierung muss die Finanzierung Freier
|
||||
Software für den öffentlichen Sektor dauerhaft sichern. Neben einem
|
||||
Kurswechsel bei der öffentlichen Vergabe braucht es dafür auch gezielte
|
||||
Förderung Freier Software für zentrale digitale Infrastrukturen. Dies
|
||||
muss sich in diesem und in allen folgenden Bundeshaushalten deutlich
|
||||
widerspiegeln. Das noch zu erstellende Budget des BMDS muss zudem
|
||||
verlässliche Mittel für die Aufgaben des Zentrums für Digitale
|
||||
Souveränität (ZenDiS) beinhalten, damit das ZenDiS öffentliche
|
||||
Verwaltungen auf dem Weg zu technologischer Souveränität durch Freie
|
||||
Software unterstützen kann. </p>
|
||||
|
||||
<p>
|
||||

<blockquote>„Wenn die Bundesregierung es mit digitaler Souveränität ernst meint,
|
||||
muss sie auf Freie Software setzen. Nur Freie Software schafft
|
||||
Herstellerunabhängigkeit, Wechselfähigkeit, Interoperabilität und Raum
|

für Innovation“, <cite>erklärt Johannes Näder, Senior Policy Project Manager
|
||||
der FSFE.</cite> „Dafür muss die Regierung sich endlich zu einer sicheren,
|
||||
langfristigen Finanzierung Freier Software und der bundeseigenen
|
||||
Freie-Software-Initiativen entscheiden, vor allem des ZenDiS. Freie
|
||||
Software muss bei der öffentlichen Beschaffung Vorrang haben, gemäß dem
|
||||
Prinzip 'Public Money? Public Code!'. Auch ein IT-Stack kann nur
|
||||
erfolgreich sein, wenn er vollständig als Freie Software entwickelt wird
|
||||
– nicht im nationalen Silo, sondern in enger Zusammenarbeit mit der EU,
|
||||
anderen Mitgliedsstaaten und vor allem dem
|
||||
Freie-Software-Ökosystem.“</blockquote>
|
||||
<p></p>
|
||||
|
||||
<h3>Hintergrund: Selbstgesetzte Ziele der Bundesregierung</h3>
|
||||
|
||||
<p>Das neue Digitalministerium wurde als Antrieb einer digitalen Zukunft
|
||||
und Motor für eine moderne, handlungsfähige Verwaltung gegründet. Freie
|
||||
Software soll dabei eine wichtige Rolle spielen. So haben CDU, CSU und
|
||||
SPD im Koalitionsvertrag beschlossen: „Wir definieren Ebenen
|
||||
übergreifend offene Schnittstellen, offene Standards und treiben Open
|
||||
Source mit den privaten und öffentlichen Akteuren im europäischen
|
||||
Ökosystem gezielt voran. […] Dafür richten wir unser IT-Budget
|
||||
strategisch aus und definieren ambitionierte Ziele für Open Source.“</p>
|
||||
|
||||
<p>Digitalminister Wildberger bekräftigte dieses Ziel im Mai 2025 bei
|
||||
der re:publica. Freie Software und Offene Standards sollen zum
|
||||
„Leitprinzip der digitalen Infrastruktur des Bundes“ werden. In diesem
|
||||
Zusammenhang plant die Bundesregierung,eine Digitalagentur zu gründen,
|
||||
die dem BMDS nachgeordnet sein wird. Dort sollen das Zentrum für
|
||||
Digitale Souveränität (ZenDiS) und der DigitalService gebündelt werden,
|
||||
möglicherweise auch weitere bislang eigenständige Organisationen.</p>
|
||||
|
||||
<p>Dass der Minister auf der re:publica den Austausch mit einer
|
||||
kritischen Community gesucht hat, war ein willkommener erster Schritt.
|
||||
Darauf muss nun eine echte, institutionalisierte Beteiligung der
|
||||
Zivilgesellschaft folgen. Nur so kann die digitale Transformation der
|
||||
öffentlichen Verwaltung allen Menschen zugutekommen und Deutschland und
|
||||
Europa wirtschaftsstark und zukunftsfähig machen. Die Zeit zu handeln
|
||||
ist jetzt.</p>
|
||||

<h3>Freie Software und „Public Money? Public Code!”</h3>
|
||||
|
||||
<p>Freie Software gibt allen das Recht, Programme für jeden Zweck zu
|
||||
verwenden, zu verstehen, zu verbreiten und zu verbessern. Durch diese
|
||||
Freiheiten müssen ähnliche Programme nicht komplett neu programmiert
|
||||
werden und dank transparenter Prozesse muss das Rad nicht ständig neu
|
||||
erfunden werden. Bei großen Projekten können Expertise und Kosten
|
||||
geteilt werden und Anwendungen stehen allen zur Verfügung. So wird
|
||||
Innovation gefördert und mittel- bis langfristig Steuergeld gespart.
|
||||
Abhängigkeiten von einzelnen Anbieterinnen werden minimiert und
|
||||
Sicherheitslücken können leichter geschlossen werden. Die Free Software
|
||||
Foundation Europe fordert daher mit über 200 Organisation und
|
||||
Verwaltungen „Public Money? Public Code!“ - Wenn es sich um öffentliche
|
||||
Gelder handelt, sollte auch der Code öffentlich sein! Mehr Informationen

||||
<p>On 14 August 2025, Germany’s government marks 100 days in office.
|
||||
CDU, CSU, and SPD had pledged ambitious Free Software goals. Yet it
|
||||
remains unclear what these goals actually are, how they will be
|
||||
achieved, and what role Free Software will play in securing Germany’s
|
||||
technological sovereignty.</p>
|
||||

|

Software Foundation Europe (FSFE) called on the
|
||||
incoming government</a> to make the controllability, security, and
|
||||
sovereignty of public digital infrastructures a top priority, and to
|
||||
achieve this by consistently using Free Software (also known as Open
|
||||
Source). Our core demands: <a href="https://publiccode.eu/">“Public Money? Public Code!”</a>, secure
|
||||
long-term funding for Free Software, capacity building, and statistical
|
||||
monitoring of progress. We need a genuine political push to <a
|
||||
href="/news/2025/news-20250103-01.html">turn the
|
||||
“Public Money? Public Code!” vision into reality:</a> All public funding for
|
||||
software must be for Free Software only!</p>
|
||||
|
||||
<p>100 days after the government took office, it is time to take
|
||||
stock.</p>
|
||||
|
||||
<h3>Procurement reform: Free Software must be prioritised</h3>
|
||||
|
||||
<p>Only days ago, on 6 August 2025, the Federal Cabinet adopted a draft
|
||||
law to accelerate public procurement procedures, aiming to make them
|
||||
more efficient, flexible, and digital. While the draft includes the
|
||||
possibility to consider digital sovereignty in tender criteria, it fails
|
||||
to seize the opportunity to prioritise and simplify the procurement of
|
||||
Free Software for public administrations. It is now up to the governing
|
||||
parliamentary groups in the Bundestag to strengthen the draft.</p>
|
||||
|
||||
<p><strong>The FSFE calls</strong> for the “Public Money? Public Code!” principle to be
|
||||
firmly embedded in public procurement, by giving Free Software clear
|
||||
priority. This is the only way to end structural dependence on
|
||||
proprietary software and its vendors, and to achieve true technological
|
||||
sovereignty. Public administrations should also be obliged to regularly
|
||||
measure and publish the share of Free Software in all software they
|
||||
procure, commission, or develop. This would make progress measurable and
|
||||
help detect undesirable developments.</p>
|
||||
|
||||
<h3>“Germany Stack”: National solo effort instead of European
|
||||
cooperation?</h3>
|
||||
|
||||
<p>By 2028, the government aims to present a “Germany Stack” – a unified
|
||||
IT architecture with base components such as cloud software and clearly
|
||||
defined interfaces, according to Federal Digital Minister Karsten
|
||||
Wildberger. But focusing on a purely national IT stack is a dead end.
|
||||
Instead, European member states should become partners, aiming for joint
|
||||
procurement and development with a focus on interoperability and sharing
|
||||
solutions without reinventing the wheel over and over again. Without
|
||||
coordination and collaboration at EU level, the stack risks
|
||||
becoming an isolated project.</p>
|
||||
|
||||
<p>It is also unclear whether the stack will be developed as Free
|
||||
Software at all. Transparency is lacking: At a first, non-public interim
|
||||
presentation in early July, representatives from civil society, Free
|
||||
Software projects and their communites were excluded.</p>
|
||||
|
||||
<p><strong>The FSFE calls</strong> on the government to think and act at the European
|
||||
level in developing an IT stack – working with European partners on a
|
||||
joint stack rather than investing resources into a questionable national
|
||||
solo effort. In any case, the Federal Ministry for Digitalisation and
|
||||
State Modernisation (BMDS) must commit to Free Software and to open
|
||||
standards compatible with Free Software, in order to create a real
|
||||
alternative to proprietary products. Civil society and the Free Software
|
||||
business sector must be involved from the outset to make use of existing
|
||||
expertise, foster acceptance, and drive genuine change towards
|
||||
technological sovereignty – at federal, state, and municipal levels, and
|
||||
across Europe.</p>
|
||||
|
||||
<h3>Federal budget: No secure, long-term funding for Free Software</h3>
|
||||
|
||||
<p>After the presentation of the 2025 federal budget and the Bundestag’s
|
||||
budget debate, it remains unclear how the government will ensure secure,
|
||||
long-term funding for Free Software. There is no sign of a strategic
|
||||
reallocation of the opulent spending on proprietary licences towards
|
||||
Free Software in line with the “Public Money? Public Code!” principle.
|
||||
The budgets for federal Free Software initiatives also remain
|
||||
precarious, with far too little funding foreseen in the Ministry of the
|
||||
Interior’s budget.</p>
|
||||
|
||||
<p><strong>The FSFE demands</strong> that the government provide secure, permanent
|
||||
funding for Free Software in the public sector. In addition to a
|
||||
procurement shift, this requires targeted financial support for Free
|
||||
Software in central digital infrastructures. This must be clearly
|
||||
reflected in this and all future federal budgets. Furthermore, the
|
||||
still-to-be-prepared BMDS budget must include reliable funding for the
|
||||
tasks of the Centre for Digital Sovereignty (ZenDiS), enabling it to
|
||||
support public administrations on their path to technological
|
||||
sovereignty through Free Software.</p>
|
||||
|
||||
<p>
|
||||

|
||||

|
||||
<h3>Background: The government’s own commitments</h3>
|
||||
<p>The newly created Digital Ministry was established to serve as a
|
||||
driver of digital transformation and a modern, capable administration.
|
||||
Free Software was meant to play an important role. In their coalition
|
||||
agreement, CDU, CSU, and SPD pledged:</p>
|
||||
|
||||
<p>“We will define open interfaces and open standards across all levels
|
||||
and strategically promote Open Source with private and public actors in
|
||||
the European ecosystem. […] To this end, we will strategically align our
|
||||
IT budget and define ambitious goals for Open Source.”</p>
|
||||
|
||||
<p>In May 2025, at the re:publica conference, Minister Wildberger
|
||||
reaffirmed this goal, saying that Free Software and open standards
|
||||
should become the “guiding principle of the federal government’s digital
|
||||
infrastructure.” In this context, the government plans to establish a
|
||||
new Digital Agency under the BMDS, bringing together ZenDiS and the
|
||||
DigitalService, and potentially other currently independent bodies.</p>
|
||||
|
||||
<p>The minister’s appearance at re:publica to engage with a critical
|
||||
community was a welcome first step. Now it must be followed by genuine,
|
||||
institutionalised participation of civil society. This is essential for
|
||||
a digital transformation of public administration that benefits everyone
|
||||
and makes Germany and Europe economically strong and fit for the future.
|
||||
The time to act is now.</p>

<p>Free Software gives everyone the right to use, study, share, and
|
||||
improve applications for any purpose. These four freedoms ensure that
|
||||
similar applications do not have to be programmed from scratch every
|
||||
time and, thanks to transparent processes, others do not have to
|
||||
reinvent the wheel. In large projects, expertise and costs can be shared
|
||||
and applications are available to all. This promotes innovation and
|
||||
saves taxpayers money in the future. Dependencies on vendors are
|
||||
minimised and security issues can be fixed more easily. The Free
|
||||
Software Foundation Europe, together with over 200 organisations and
|
||||
administrations, is therefore calling for “Public Money? Public Code!” -
|
||||
If it is public money, it should be public code as well! More
|
||||
